Appeal over jurisdiction for air passenger compensation claims

Air Passenger Rights is appealing a B.C. Supreme Court ruling that claims for standardized compensation arising from flight delays, cancellations and denied boarding fall within the exclusive jurisdiction of the Canadian Transportation Agency rather than the Civil Resolution Tribunal. The appeal also raises whether an assignment of passengers’ claims to Air Passenger Rights is valid under s. 36 of the Law and Equity Act and whether Air Passenger Rights has standing to seek judicial review of the CRT decision.
