Defended complex negligence action arising from supervision of high-risk offender
The B.C. Supreme Court found the Province negligent in its supervision of a convicted sex offender, Kline, who was permitted to live in the same residence as a mother and her two young children despite being assessed as a high risk to reoffend and being prohibited from unsupervised contact with minors. Kline subsequently sexually assaulted the boy. The Court apportioned liability 75% to Kline, 20% to the Province and 5% to the mother, and awarded substantial damages to the child; the apportionment was later varied on appeal.
