Upheld dismissal of mink farmers’ misfeasance and constructive-taking claims

The B.C. Court of Appeal upheld the dismissal of claims by mink farmers challenging regulations that effectively ended mink farming in the province. The Court found that the regulations were authorized by the Animal Health Act and that the pleaded claims for misfeasance in public office and constructive taking had no reasonable prospect of success.
