Strata support-service fee dispute addressing bylaws and limitation period
The B.C. Supreme Court dealt with a dispute over whether strata owners were required to pay fees for support services associated with their seniors’ condominium development. The Court addressed the enforceability of the strata’s bylaws and service-fee arrangements and, on the limitation issue, held that a claim may not be discovered until court proceedings become an appropriate means of seeking relief, particularly where the claimant is first pursuing another process capable of resolving the dispute.
