Defended refusal to redact Review Board reasons under open-court principles
The Review Board had held that s. 672.51(7) of the Criminal Code did not authorize it to redact its disposition reasons. The Court agreed with that statutory interpretation, but held that the Board had erred by failing to consider its inherent/implied authority to control its own process, which includes authority to consider limits on public access. Despite that error, the Court dismissed the application because the Board’s alternative conclusion—that the requested redactions were not justified under the open-court principles—was reasonable.
